The purpose of TUPE is to protect employees' jobs and their access to statutory benefits. It's the preservation of tenure and employment rights. To learn more, see HMRC's Business transfers, takeovers and TUPE.

Marking employees as TUPE protected in Bob and UK Payroll ensures that statutory payments and allowances are calculated correctly and automatically.

Before you begin

In your Bob integration in UK Payroll, ensure that your Date hired and Original start date field mapping is accurate.

UK Payroll field Bob field Notes
Date hired Work: Start date This is the date the employee officially joins the new payroll scheme. It is used to track the employee's start date for PAYE purposes, which affects their tax and National Insurance contributions.
Original start date Work: Original start date This date reflects the first date the employee started working for the company, regardless of changes in employment status. This date is crucial for determining the employee's continuous employment. It's used to calculate statutory rights (such as parental leave or redundancy) and for reporting purposes.

To learn more, see Configure your Bob integration in UK Payroll.

How to record continuous employment

Marking employment as continuous ensures that an employee's start date for benefits and tenure remains consistent.

Or, if your company is undergoing Transfer of Undertakings (Protection of Employment, aka TUPE), you can flag protected employees in UK Payroll.

  1. (For TUPE only) Using the people importer in Bob, import your employees as Terminated. To learn more, see Import people data. Ensure that you enter each employee's Original start date and their Start date separately.

Tip: To make the process smoother, include all of the information that you want to enter into Bob (i.e. their manager, their job title, etc.).

  2. Rehire each employee. To learn more, see Rehire an employee.

Note: Ensure that you give each employee a new and unique employee ID for payroll purposes.

  3. Since each employee's Original start date is before their Start date in Bob, the Continuous employment box in UK Payroll will be automatically marked, and the correct date noted.
